Implikasi Yuridis Putusan Pailit PT Sritex Terhadap Pemenuhan Hak-Hak Ketenagakerjaan
Abstract
The fulfillment of workers' rights within bankruptcy proceedings remains a critical issue in Indonesia's legal system. This study analyzes the legal implications of the bankruptcy ruling against PT Sri Rejeki Isman Tbk (Sritex) on the fulfillment of labor rights. The declaration of PT Sritex's bankruptcy by the Commercial Court of Semarang in 2024 resulted in legal consequences, including a general seizure of company assets and settlement by a curator. This study examines the position of workers as preferred creditors under the Manpower Act and Constitutional Court Ruling No. 67/PUU-XI/2013, which stipulates that outstanding wages must be prioritized over all other types of creditors, including secured creditors. Other normative rights, such as severance pay, long service pay, and compensation for rights, rank after secured creditors but before concurrent creditors. Although the legal framework provides priority protection for workers, its implementation in the PT Sritex case faces challenges due to the company's total debt significantly exceeding its asset value. The research concludes that in the settlement of PT Sritex's bankruptcy estate, the curator should refer to the Constitutional Court's Ruling to ensure the protection of labor rights.
